European Food Law

In EU, Governance identifies a crucial dimension of the European Legal System, which cannot be identified only in Treaties, Directives and Regulations per se considered, but which consists in the integration of a multi-level system of rules, integrating International, European, National, and Regional levels.

In such framework, European Food LawEFL is commonly recognised as an extraordinary laboratory, where new institutes and rules have been tested: from mutual recognition, to precautionary principle, to crisis management; and where new models of regulation, integrating public and private responsibilities are emerging in a significant and long lasting process of integration.

The composite nature of EFL requires the use of English language as an essential tool to get direct knowledge of soft law and hard law documents, and to share ideas, researches and models, crossing a national dimension which is exposed to the risk of a dimension of self-consideration, incapable to participate to the daily creation and evolution of European disciplines.

Taking into account this perspective, the Seminar will be organised in 5 sessions, each devoted to a specific topic, relevant in the present debate on EFL:

  1. European Institutions of Agricultural and Food Law after the Lisbon Treaty (download MATERIALS April 15, from 10:00 to 14:00);
  2. The European systemic approach to Food Safety (download MATERIALS May 6, from 10:00 to 14:00);
  3. Pro-active Consumer as new paradigm in European law (download MATERIALS May 13, from 10:00 to 14:00, file aggiornato in data 12/05/2014);
  4. Responsibility, liability and allocation of costs of the Rapid Alert System: a case law analysis of the economic effects of the present regulatory and judicial doctrines (download MATERIALS May 20, from 10:00 to 14:00);
  5. Discussion of papers prepared by the participants (May 27, from 10:00 to 14:00).



The Seminar will be also an occasion to practice innovative teaching methods, with the use of the e-book inter-active version of "European Food Law" recently published by CEDAM (Wolters Kluwer Ed.).

The students will receive a free password to access to the e-book with no costs, and will be asked to participate in an active way to the use of new teaching tools.
The sessions will follow a lecture format, working on the direct reading and discussion of legal documents, and will include a final discussion with an oral presentation of the participants.
The grading of the seminar is 10 cfu (corresponding to "altre attività formative") for 5 weeks, 4 hrs per week.

Students attending the seminar are provided with sample readings, working papers and bibliography. Detailed instructions will be distributed for all elements of the class. See also files posted on Prof. Albisinni website on DISTU Department .

The seminar will take place in San Carlo, Aula 2, on April - May 2014 (April 15, May 6, May 13, May 20, May 27) from 10:00 to 14:00.
